A Baltimore County Judge has decided to overturn the $38 Million Wrongful Death award to Korryn Gaines’ Family.
In 2016, Korryn Gaines was shot and killed after a six-hour standoff with Baltimore County Police, after pointing a shotgun at officers while they were trying to serve her an arrest warrant.
After the death of Gaines, her family filed a lawsuit claiming that the officers used excessive force when they fatally shot the 23-year-old and injured her 5-year-old son.
The jury sided with the family, and they were awarded $38 million in damages, including $33 million to her son, Kodi, $4.5 million to her daughter, Karsyn, and $9,000 to her parents and estate.
A year after being awarded the $38 million, Baltimore County Circuit Court Judge Mickey Norman decided to dismiss the family’s claims against the county and against Corporal Royce Ruby Jr., who fatally shot Gaines, according to CBS Baltimore.
The judge cited “Qualified Immunity, ” which shields law enforcement and government officials from civil liability when carrying out their duties.
