Actor Jussie Smollett may have got a break, federal law enforcement sources told TMZ barring any major future development regarding his fake hate mail case, the feds will NOT charge Jussie.

This is good news for Smollett, who was a part of an elaborate hoax that just got him sentenced to 5 months behind bars, but the infamous hate letter case will likely go unheard.

As reported the studio received a threatening letter that was directed at the “Empire” star 8 days before he was “attacked,” it had scrapbook-style letters reading a warning: “You will die black f**,” along with an image of a noose.

Some authorities believe the actor sent the racist and homophobic letter to himself, with hopes that it would put him smack in the middle of the social justice movement.

Federal investigators seem content with the sentence Jussie received following the verdict from a jury that convicted him on 5 felony counts for lying to police about the incident.

He was sentenced to 150 days in jail with 30 months of felony probation.

Sources say the feds feel as if it would be “piling on” to hit Smollett with additional charges.
