Prosecutors revealed new claims involving videos allegedly found on the 15-year-old’s phone as his defense fights for bond and asks to move his seven-count felony case to juvenile court.

Kim Zolciak’s Son KJ Biermann Allegedly Had Sexual Videos With a Relative Under 12 on His Phone, Prosecutors Reveal In Court

Kim Zolciak’s son, Kroy “KJ” Biermann Jr., legal troubles took another serious turn Friday when prosecutors raised previously undisclosed allegations during the 15-year-old’s bond hearing in Georgia. According to TMZ, Deputy District Attorney Caitlin McGillicuddy told the court that investigators discovered videos on Biermann’s phone that prosecutors believe show sexual contact involving a relative younger than 12. TMZ reported that it remains unclear how old Biermann was when the alleged videos were recorded.

The new claims are separate from the seven felony charges currently driving the KJ Biermann case in Fulton County Superior Court. Prosecutors have not publicly indicated that the alleged videos involving the relative have resulted in additional charges in the Superior Court case.

McGillicuddy alleged there were “multiple encounters” captured in videos discovered on the phone. She also claimed Biermann used “predatory, derogatory” language toward the alleged victim. Those descriptions are allegations made by the prosecution and have not been proven in court.

The prosecutor also disclosed another piece of previously private history during Friday’s hearing. McGillicuddy said Biermann had previously been charged with sexual battery involving a victim younger than 16 in a juvenile matter and had been under court supervision in connection with that case since October 2025.

Because juvenile proceedings generally receive greater confidentiality protections, the earlier matter had not previously been made public.

Friday’s developments add another layer to a KJ Biermann case that was already carrying potentially life-changing consequences.

A Fulton County grand jury indicted Biermann on September 3 on seven felony counts connected to an alleged April 23 encounter with a 15-year-old female classmate at a Life Time Fitness location in Alpharetta. The indictment includes aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment, and three counts of sexual battery against a child under 16.

FOX 5, citing Fulton County Superior Court filings and its previous reporting, said investigators allege Biermann unlawfully restrained the teenager inside a changing area and subjected her to sexual acts without her consent. The outlet reported that police began investigating after the April encounter and arrested Biermann on August 17.

The April accusation should not be confused with the separate allegations prosecutors presented Friday involving the younger relative. The seven-count indictment concerns the female classmate and the alleged gym incident.

According to FOX 5, medical staff examined the teenager following the April allegation, and testing did not reveal male DNA. Biermann’s defense has repeatedly pointed to that finding while disputing the accusations.

His mother, former “Real Housewives of Atlanta” cast member Kim Zolciak, has also publicly defended him. Zolciak said her son voluntarily took and passed a polygraph examination and maintained that no DNA belonging to him was found during the examination of his accuser. She has urged the public to allow the legal process to play out rather than reach conclusions before trial.

Attorney Jason Sheffield has likewise maintained Biermann’s innocence in the KJ Biermann case and is expected to enter a not guilty plea on his behalf. Biermann’s arraignment is scheduled for October 14.

The defense is also seeking a major change in how the case proceeds.

Sheffield filed a motion requesting that the criminal case be transferred to juvenile court and that the proceedings be afforded confidentiality protections. Biermann was 14 at the time of the alleged April incident and is now 15.

Georgia law helps explain why the charges are currently in Superior Court even though Biermann is a minor. Under Georgia Code Section 15 11 560, children between 13 and 17 accused of certain serious offenses, including aggravated sodomy, aggravated child molestation, and aggravated sexual battery, fall under the original jurisdiction of the Superior Court. 

That legal framework makes the juvenile court dispute one of the most important issues surrounding the KJ Biermann case beyond the underlying question of guilt or innocence.

Bond is another immediate battle.

According to TMZ, Sheffield asked the judge to release Biermann on a $65,000 bond. McGillicuddy opposed his release and alternatively requested a bond of $190,000. Prosecutors argued against release while the defense emphasized Biermann’s age, education, athletics and community ties.

As of the latest reports Friday afternoon, the judge had not issued a publicly reported final bond decision, and Biermann remained in custody at the Metro Regional Youth Detention Center.

Zolciak, Kroy Biermann and Biermann’s older sister Brielle Biermann attended Friday’s court proceedings in support of him.

The latest hearing significantly expands the public picture of the KJ Biermann case, but it does not establish guilt. The seven felony counts stemming from the April allegation remain pending; the defense plans to contest them, and the allegations disclosed Friday concerning the younger relative remain accusations presented by prosecutors as the court weighs Biermann’s request for release.
