Just days prior to the Daytona 500 and Sprint Cup driver Kurt Busch is out. After an incident last September involving his girlfriend, a family court judge has determined that based on evidence presented Busch likely committed an act of domestic violence. Busch has been suspended indefinitely and is not be able to participate in anything NASCAR related, that includes Daytona 500.

Busch reportedly smashed his then girlfriend Patricia Driscoll’s head against a wall and strangled her inside his mobile home at Dover International Speedway last year. A protective order was put into place on Monday which prevented Busch from seeing or contacting Driscoll. Busch has yet to actually be criminally charged with domestic violence, though the courts civil investigation is done.

Chevrolet has also suspended its affiliation with Busch, as well as driver Regan Smith replacing Him in the Daytona 500.

Following the ruling, Busch has officially appealed his NASCAR suspension. Busch’s attorney released a statement in its regards. “We ask everyone’s patience as this case continues in the court of law and are confident that when the truth is known Mr. Busch will be fully vindicated and back in the driver’s seat.”
