Letitia James Sues Trump Administration Over Elon Musk’s Access to Americans’ Private Data—Wins Court Battle [Video]

New York Attorney General Letitia James just won a major legal battle against Donald Trump and Elon Musk, blocking Musk’s access to millions of Americans’ private data.

The lawsuit, filed by James and other Democratic attorneys general, accused Trump of unlawfully granting Musk and his Department of Government Efficiency (DOGE) access to Social Security numbers, addresses, tax returns, and other sensitive government records.

According to James, Musk and his DOGE team were using this information to interfere with federal payments for critical services like health care and child care. In a Twitter post yesterday, she made her stance clear:

“We’re suing over the free rein Donald Trump gave Elon Musk and DOGE to access Americans’ private information. Musk and DOGE want to use this information to cut vital services that Americans rely on—from health care to education. This is unacceptable and illegal.”

In a video statement, James reinforced that Trump had no authority to hand over such private data, nor the power to bypass Congress-approved federal spending. She vowed to fight back against what she called an “unprecedented and unauthorized attack” on Americans’ privacy.

This morning, James delivered an update, announcing a victory in court:

“This morning, we won a court order blocking Elon Musk, the world’s richest man, from accessing Americans’ private data. Musk and his DOGE employees must destroy all records they’ve obtained. I’ve said it before, and I’ll say it again: no one is above the law.”

This ruling is a major setback for both Trump and Musk, raising legal and ethical concerns over data privacy and government oversight. While Musk has yet to respond publicly, legal experts predict this won’t be the last fight over DOGE’s role and its authority.
