A 22 year old Burger King employee named Desmond was shot and killed after a dispute over a delayed drive thru order, according to local news reports.
The shooting happened on Saturday at a Burger King on the 7000 block of East Colonial Drive in Orlando. Investigators say the restaurant was busy that night and the drive thru line was backed up. A woman reportedly got out of her car to complain about the wait and said she would call her man to the restaurant. An employee refunded her $40 and asked her to leave.
Authorities say she left but came back a short time later with a 37 year old man identified as Kelvis. Investigators say he told Desmond to fight him.
According to police, a witness broke up the fight after Kelvis put Desmond in a headlock. Authorities say Kelvis then went to his truck, pulled out a gun and told Desmond he had two seconds before he would shoot. Investigators say he fired and left the scene.
Desmond was found with a gunshot wound and taken to a hospital, where he died. Police said he had only started working at the restaurant a few days earlier.
Investigators said Kelvis was interviewed after the shooting. According to the reports, he acknowledged firing the gun and said he had put it in a place where it could not be found. He was charged with first degree murder with a firearm, destruction of evidence and possession of a firearm by a convicted felon. Those charges are allegations, and the case had not gone to trial when this story ran.
