Boosie is asking a federal judge to spare him prison time as he awaits sentencing in his gun possession case, arguing that incarceration would amount to “unnecessary incarceration” rather than meaningful accountability.

According to newly filed court documents shared by court reporter Meghan Cuniff, the rapper’s legal team is pushing for probation and community service instead of prison, following his guilty plea to being a felon in possession of a firearm. The charge stems from a 2023 traffic stop in San Diego, where police discovered a handgun inside a vehicle Boosie was riding in. No one was injured, and the incident was not connected to any violent crime.

In their sentencing memo, Boosie’s attorneys argue that prison time would serve little purpose, describing the situation as a “nonviolent offense” and a “lapse in judgment.” They also stress that locking him up would be “unnecessary incarceration,” especially given his age, family responsibilities, and ongoing career. The defense is requesting a sentence that includes supervised probation, community service, and conditions aimed at rehabilitation rather than punishment.

Federal prosecutors see it differently. They are asking the court to impose a two-year prison sentence, citing Boosie’s criminal history and the seriousness of gun possession by a convicted felon. Prosecutors argue that incarceration is needed to promote respect for the law and deter future conduct.

Boosie, born Torence Ivy Hatch Jr., accepted a federal plea deal in August after the case moved from state to federal court. His sentencing is expected to take place on Friday, January 9, 2026.

The judge will ultimately decide whether Boosie walks away with probation or heads to prison, a ruling that could shape the next chapter of his career and public life.
