Diddy’s fight against the feds just got more intense.
After filing a motion to have his superseding indictment thrown out on the grounds that the law itself is racist, prosecutors are shutting it down—calling his argument “outrageous and illogical.”
According to court documents, the government insists that “race played no role whatsoever in the decision to seek the charges contained in the Indictment, which instead stemmed from the defendant’s decades of criminal conduct.”
They argue that Diddy’s claims are nothing but speculation and that his motion should be denied.
Diddy’s legal team filed the motion on February 18, taking aim at the charge of transportation to engage in prostitution under the Mann Act—one of three charges he’s facing alongside sex trafficking and racketeering. His lawyers argue that no white person has ever been prosecuted under the law, claiming that the music mogul is being targeted simply because he’s a “powerful Black man.”
“What was racist in its inception has often been racist in its operation,” the filing states. It also maintains that any sexual activity involving Diddy was consensual and that the government is spinning a narrative to bring him down.
Beyond the charges, Diddy’s team is also accusing federal prosecutors of leaking information to the press in an attempt to ruin his reputation before trial.
“The government’s handling of this case demonstrates bias and animus,” the motion claims. “It has gone out of its way to humiliate Mr. Combs and to prejudice the jury pool with pretrial publicity that plays on racist tropes.”
This isn’t the first time Diddy has pushed back against what he sees as a racially motivated case, but the feds aren’t budging.
They maintain that the case is built on evidence, not race, and that he will have to face the charges head-on in court.
