Julio Foolio Murder Suspect Leaning Toward Insanity Defense to Dodge Possible Death Penalty

The attorney for one of the suspects allegedly involved in the killing of rapper Julio Foolio is preparing for a “possible insanity defense,” according to court records.

A motion filed on November 19th in a Hillsborough County court seeks the appointment of a confidential forensic neuropsychologist to examine Rashad Murphy, who was arrested in July following a standoff in Jacksonville.

Murphy faces multiple charges in connection with the rapper’s death. Attorney Daniel Hernandez, in the motion, stated, “Cases involving NGI — Not Guilty by Reason of Insanity — are very complicated.” He further noted that the doctor requested to examine Murphy has experience with similar cases.

“The doctor sought has been involved with several NGI cases over their career. One is required to complete a comprehensive report on the Defendant,” the legal docs read.

The motion also emphasized the need for an “extensive” clinical interview, along with psychological and neuropsychological testing. Hernandez stressed that “An NGI case such as this should be treated just like a death penalty case,” explaining that both the defense and prosecution should have access to equally qualified clinicians. The forensic psychologist’s fees, previously approved at $300 per hour, plus $125 for travel, with a $15,000 cap, are expected to be covered by the state of Florida. Murphy’s history, such as school records, employment history, and medical records, may also be used in the analysis to make a ruling. Interviews with family and friends could also be requested.

Murphy is just one of the accused shooters involved in the killing of Foolio. Isaiah Chance, Alicia Andrews, and Sean Gathright are also facing murder charges for the Tampa ambush. All four have pleaded not guilty. Meanwhile, the prosecution has revealed that they could seek the death penalty.

The judge has not yet ruled on Murphy’s motion.
