Rep. Eric Swalwell, a Democrat from California, is suing former President Donald Trump, his son Donald Trump Jr., Rudy Giuliani and Rep. Mo Brooks from Alabama, claiming that they all incited the violence that occurred on January 6th during the U.S. Capitol Riot.

According to the New York Post, Swalwell claims Trump and his cronies violated civil rights by attempting to block the political process and the peaceful transfer of presidential power.

The suit was filed in federal court in Washington, D.C. on Friday, and follows Mississippi Rep. Bennie Thompson, who also sued Trump weeks ago, claiming he launched a drawn-out attempt to overturn the election results.

Swalwell’s suit alleges Trump and the other defendants violated local laws in D.C. by inciting the mob to storm the nation’s Capitol while his own Vice President Mike Pence was in the Senate chamber working to certify the results of the 2020 presidential election.

“As a direct and foreseeable consequence of the Defendants’ false and incendiary allegations of fraud and theft, and in direct response to the Defendants’ express calls for violence at the rally, a violent mob attacked the U.S. Capitol,” Swalwell’s suit stated.
