Republican South Carolina lawmakers are once again attempting to pass a controversial bill that could allow prosecutors to charge women who have abortions with homicide.

The legislation, known as the “South Carolina Prenatal Equal Protection Act of 2023,” was first introduced in January 2023. Although it sparked significant debate, the bill ultimately failed to advance during its initial session. Now, seven lawmakers, many hailing from the state’s Upstate region, have refiled the proposal in hopes of gaining traction in the current legislative session.

The bill seeks to amend the South Carolina Code of Laws by expanding the legal definition of a “person” to include an unborn fetus. If passed, this change would make women who have abortions eligible for homicide charges. In South Carolina, a death penalty state, these charges could lead to capital punishment.

The reintroduction of this bill has reignited debates over abortion rights and women’s autonomy, both within South Carolina and across the country.
