The Supreme Court lifted the Biden administration’s latest federal ban on evictions, granting a group of landlords’ bid to block the pandemic-related protections offered to renters facing eviction in most of the country.

In an eight-page, unsigned opinion, the court wrote, “Congress was on notice that a further extension would almost surely require new legislation, yet it failed to act in the several weeks leading up to the moratorium’s expiration.”

This round of litigation was brought forth by landlord groups who challenged the latest version of the moratorium from the US Centers for Disease Control and Prevention earlier this month, days after the July 31st  expiration date of the last iteration.

While the three liberal justices publicly dissented the opinion, the court said, “If a federally imposed eviction moratorium is to continue, Congress must specifically authorize it.”
