A Texas bartender has been charged in connection with a 2017 mass shooting in Plano. Police say the bartender, Lindsey, served alcohol to the gunman before he left the bar and killed his estranged wife and seven other people at a football watch party.

According to NBC, police allege that Lindsey served the gunman, Spencer, at The Local Public House even though he appeared intoxicated. Spencer later died in a shootout with police. Autopsy results reportedly showed his blood alcohol level was about four times the legal limit, and investigators say she should have known not to serve him. She was arrested and charged with violating the state’s alcohol code.

The law prohibits selling alcohol to an intoxicated person. Lindsey’s attorney pushed back in a statement, saying she knew Spencer, was concerned about him and tried to keep him from drinking. “Not only did she know Spencer, but she was friends with Meredith and was supposed to be at the party that evening,” he said. “It is shameful of the Plano Police department to go after the person who was vital in trying to stop the horrific events of that evening.”

The charge is an allegation, and Lindsey is presumed innocent unless proven guilty in court.
