A second man has been charged in the shooting death of 7 year old Jazmine Barnes of Houston.

The Harris County Sheriff’s Office said a man named Larry is now facing a capital murder charge. According to CNN, investigators arrested him on a drug possession charge and say they also gathered additional corroborating evidence tying him to the case. A preliminary hearing is set for Thursday morning.

Eric, the first suspect arrested, was stopped in a routine traffic stop and booked on a marijuana charge. Authorities say he is the accused driver in the 7 a.m. drive by shooting, and that police believe the shooting may have been a case of mistaken identity.

Sheriff Ed Gonzalez credited the persistence of homicide investigators for gathering evidence that matched tips from the public. He also thanked activist Shaun King for passing along an anonymous tip that helped lead police to the first suspect.

Eric, who is 20, has a first court date scheduled for February 15. District Attorney Kim Ogg’s office has not said whether it will seek the death penalty.

Both men are presumed innocent until proven guilty in court.
