Trump has officially ended Washington D.C.’s cashless bail system through a new executive order signed on August 25 2025. The move puts an end to decades of policy in the nation’s capital where judges released most defendants before trial without requiring money.
Under the new order Attorney General Pam Bondi is directed to restrict federal funding from jurisdictions that continue cashless bail practices. In D.C. the change means that many people accused of crimes will need to pay for their release or remain in jail until their trial date.
For years D.C. operated as one of the few places in the country where freedom before trial was not based on wealth. Instead judges used assessments of risk to decide who should stay locked up.
The clash over bail is nothing new, but Trump’s decision to end cashless bail in the capital puts the issue back in the spotlight. For many residents it raises the question of whether freedom before trial should depend on money or on risk to the community.
