Court filings in Derrick Rose’s civil lawsuit include statements from people who say they know the woman suing him, according to reports from TheWhiteBronco.com and Black Sports Online. Rose, who has denied wrongdoing, is set to appear in court on October 4.
The plaintiff, identified in court papers as Jane Doe, alleges that Rose and two friends entered her home and sexually assaulted her after the group spent time together the day before. Rose’s side has said the encounter was consensual and has argued the lawsuit stems from a financial dispute. The plaintiff’s side disputes his account.
In a declaration, a friend named Gabriela said the plaintiff told her during a trip to Las Vegas that the encounter was consensual. Gabriela stated that she asked directly whether an assault had occurred and that the plaintiff said no. She also said the plaintiff later told her she planned to sue and expected a settlement. These are Gabriela’s statements as filed, and they have not been tested at trial.
According to Black Sports Online, this is the second time someone close to the plaintiff has filed a statement for the defense. A former roommate and co worker said in a filing that she believed the lawsuit was unfair to Rose. That filing came after the plaintiff’s attorney objected to the release of text messages between the two women to a basketball website.
The plaintiff’s attorneys have not accepted the defense account, and the allegations remain unproven. Rose has also asked the court for a gag order on the plaintiff and her team to limit what is said to the media. He has said he knows nothing about a criminal investigation, adding, “I haven’t talked to anyone and this is my first time hearing about it and once again I am not worried about it, I felt like I didn’t do anything wrong.”
