The production company behind Comedy Central’s new show, “Lights Out With David Spade” is being sued after an employee left the party intoxicated and killed a pedestrian following a car collision.
According to Yahoo Finance, Noah Benardout was struck and killed after being hit by a car that had just been in a violent car accident on August 1, 2019.
The lawsuit was filed by the victim’s parents, claiming the production company “hosted an employee party for the premier” in Hollywood at the Nightingale Plaza Nightclub. They also named the driver, Jacob Gralitzer, who was invited by the company to attend the party that night.
The suit claimed the event, “provided an open bar serving alcoholic beverages,” adding that during that time Gralitzer, “drank a multitude of alcoholic beverages which caused him to be severely intoxicated.” ⠀⠀⠀⠀⠀⠀⠀⠀⠀
He then reportedly got in his car to leave the party and allegedly had been “speeding more than 30 miles per hour in excess of the posted speed limit, and weaving in and out of traffic.”
The suit said Gralitzer then got into an accident and was catapulted into Noah who was standing nearby on the sidewalk. Noah was killed from blunt force trauma to the head.
“This wrongful death case stems from a drunk driver…who became inebriated at a company party and then recklessly drove his 2018 silver Infiniti Q60S…at high speeds through West Hollywood causing a severe vehicular collision which resulted in striking and killing 24-year-old pedestrian Noah Benardout,” the documents read.
As a result, the victim’s parents are suing the production company behind “Lights Out With David Spade” and Viacom for the wrongful death. The family is asking for economic damages suffered in relation to loss of earnings and loss of financial support from Noah, funeral and burial expenses, hospital and medical bills, and lastly, loss of personal property.
