Woman Sues Kellogg’s for Being Stingy with the Berries in Strawberry Pop-Tarts

Kellogg’s is facing a new lawsuit from a woman claiming that strawberry Pop-Tarts don’t contain enough strawberries.

New York resident Elizabeth Russett is seeking justice in the newly filed class-action lawsuit. She alleges that the strawberry flavored filling is actually made mostly of pears, apples, with very few strawberries contributing to the toaster pastry’s actual flavor and nutritional advantages.

Russett also points out the health benefits of strawberries, claiming that they are a higher grade fruit than pears and apples in her lawsuit. She is seeking damages of $5 million. Russett is also pushing for Kellogg’s to include more accurate labeling on their Frosted-Strawberry Pop-Tarts box. 

“The product’s common or usual name of ‘Frosted-Strawberry Toaster Pastries’ is false, misleading, and deceptive because its filling contains a relatively significant amount of non-strawberry fruit ingredients — pears and apples,” the lawsuit reads. 

In addition to the fruit concoction that makes up the strawberry Pop-Tarts, the filling includes vegetable juice for coloring and paprika extract color.

Kellogg’s has not publicly responded to the lawsuit.
