Kim Zolciak and Kroy Biermann’s 15 year old son, Kroy “KJ” Biermann Jr., has been arrested and charged with aggravated sodomy and aggravated sexual battery, according to court documents obtained by TMZ.
The charges stem from a report a teenage classmate made to police in the spring. According to the documents, an officer was dispatched to North Fulton Hospital in Georgia on April 24 for a reported sexual assault. The girl and her father told police the incident had happened the previous day at a nearby gym. She said she was there when she ran into Kroy Biermann Jr., that the two headed toward a co-ed sauna, and that the alleged assault occurred in a changing area they passed through on the way. She told police she said no.
Baller Alert is not publishing the detailed description of the alleged acts contained in the police report. The accuser is a minor, and the charges themselves convey the seriousness of what is alleged.
Both charges are among the most serious felony sex offenses in Georgia law. Because Kroy Biermann Jr. is 15, one of the first things to watch is which court hears the case. He has been charged, not convicted, and no plea has been reported. TMZ said it reached out to both Kim Zolciak and Kroy Biermann for comment and had not heard back.
The arrest arrives in the middle of a family situation that has been playing out in court and in public for three years. Zolciak and Biermann married in 2011 and separated in April 2023, and the divorce has been unusually contentious, with dueling filings, allegations traded in both directions, and repeated hearings. Zolciak lost custody of the children in May. The couple share four biological children, including Kroy Jr., a 14 year old son, and 12 year old twins. Biermann also adopted Zolciak’s two older daughters, Brielle and Ariana, after the marriage.
