Despite Simon Guobadia being in ICE custody, his divorce from “Real Housewives of Atlanta” star Porsha Williams is pushing forward.

In Touch reports that Guobadia, 60, remains locked up in an ICE detention center and was “unable to appear” at the April 30 hearing due to his detention. The judge noted that ICE “has advised that upon receiving a production order, arrangements will be made to transport [Simon] to physically appear” in court.

Guobadia’s lawyer requested a delay, calling the motion to enforce the prenup “a substantive motion that requires findings of fact by this Court.” The court granted the continuance, rescheduling the hearing for June 11. If Simon is released before then, the court may allow remote proceedings.

Williams, 43, filed for divorce in February after 15 months of marriage. She is seeking enforcement of their prenuptial agreement, which Simon opposes. According to his attorney, “The Wife failed to disclose that she would return to her employment on ‘The Real Housewives of Atlanta’ as a cast member,” and claimed she misled him during negotiations. “But for the Wife’s misrepresentations…the Husband would not have signed off on the Prenuptial Agreement,” he argued.

Williams’ team fired back: “Husband’s detention… is the direct result of his attempt to illegally enter the United States,” calling it a “foreseeable legal consequence.” Her lawyer added that Guobadia “was fully aware of his longstanding immigration challenges.”

As one source told In Touch, “the businessman remains locked up,” despite expectations of a recent release. The case is ongoing.
